Your Right To Union Representation

As a member of the National Border Patrol Council Local 2455, you have the right to Union representation during any INVESTIGATORY INTERVIEW conducted by any member of MANAGEMENT. Known as WEINGARTEN RIGHTS, the right to Union representation safeguards you from making statements that may lead to disciplinary action up to removal from Federal Service. 

Union Representation ensures that management follows proper questioning and investigatory procedures. Asserting this right is not an admission of wrongdoing.

If management  or any internal investigative entity (OIG, OPR, MIT, etc.) wants to question you about an alleged violation of agency policy, request Union Representation immediately.

Demand Union representation.

Your right to Union representation is not automatic. You must request that a Union Representative be present during any and all questioning.

Do not give up your right to Union representation.

Even if you initially proceed with the questioning without Union representation, you can request your right to Union representation at any time during the questioning. Any statement you make can be used against you!
